WAIVER OF LIABILITY, RELEASE OF CLAIMS

ASSUMPTION OF RISK & INDEMNIFICATION AGREEMENT

⚠  READ THIS DOCUMENT CAREFULLY.  THIS IS A LEGALLY BINDING AGREEMENT THAT AFFECTS YOUR LEGAL RIGHTS.  ⚠

All participants and guests acknowledge and understand that participation in basketball and related athletic activities at the San Antonio Basketball Association & Sports Armour Basketball (SABA) facility involves inherent risks, dangers, and hazards. These risks include, but are not limited to:

·               Physical contact between participants, including collisions, falls, and body-to-body contact

·               Muscle strains, sprains, fractures, dislocations, and other orthopedic injuries

·               Head, neck, and spinal injuries, including the risk of concussion

·               Cardiovascular events including heart attack, stroke, or sudden cardiac arrest

·               Slipping, tripping, or falling on court surfaces, bleachers, locker rooms, or common areas

·               Injuries caused by sports equipment including basketballs, hoops, backboards, and court  fixtures

·               Injuries sustained as a spectator or bystander near active play areas

·               Heat-related illness or dehydration during physical activity

·               Injuries arising from the actions of other participants, players, coaches, or guests

·               Property damage or loss of personal belongings while at the facility

I voluntarily assume all risks associated with my participation in or presence at any SABA activity or event, whether or not those risks are listed above. I acknowledge that these risks cannot be eliminated and that my participation is entirely voluntary.

RELEASE OF LIABILITY & WAIVER OF CLAIMS

In consideration of being permitted to participate in activities at SABA, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, I, on behalf of myself and my heirs, personal representatives, executors, administrators, and assigns, hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE:

San Antonio Basketball Association & Sports Armour Basketball (SABA),  and all of their respective owners, members, officers, directors, employees, agents, contractors, volunteers, coaches, referees, and facility staff

(collectively, the "Released Parties") from any and all claims, actions, causes of action, demands, rights, damages, costs, losses, expenses, and compensation whatsoever (including attorneys' fees and court costs), whether known or unknown, foreseen or unforeseen, which I now have or which may hereafter arise out of or relate to:

·               Any injury, illness, death, or property damage I sustain while at the SABA facility or participating in any SABA event or activity

·               The negligence of the Released Parties in any form, including but not limited to negligent supervision, instruction, or facility maintenance

·               Any defect in the premises, equipment, or facility

·               The conduct of any other participant, spectator, coach, referee, or third party at the facility

THIS RELEASE INCLUDES CLAIMS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS BY SIGNING THIS DOCUMENT.

INDEMNIFICATION & HOLD HARMLESS

I agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) my participation in any SABA activity; (b) my presence at the SABA facility; (c) my breach of this Agreement; or (d) any act or omission by me or any minor for whom I am signing this Agreement.

MEDICAL AUTHORIZATION & EMERGENCY TREATMENT

In the event I am unable to make my own medical decisions due to injury, illness, or incapacity sustained while at the SABA facility, I hereby authorize SABA staff to: (a) contact emergency medical services (911); (b) provide basic first aid; and (c) consent to emergency medical treatment on my behalf. I understand and agree that SABA and its staff are not responsible for the quality or outcome of any emergency care provided.

 PHOTO, VIDEO & MEDIA RELEASE

I grant San Antonio Basketball Association (SABA) and its authorized representatives the right to photograph, film, and record my image, likeness, and voice during events and activities at the SABA facility. I authorize SABA to use such materials for promotional, marketing, social media, and educational purposes without compensation to me.

ACKNOWLEDGMENT OF FACILITY RULES & CODE OF CONDUCT

I agree to abide by all SABA facility rules, policies, and codes of conduct, including but not limited to:

·               No fighting, threatening behavior, harassment, or abusive language toward any player, coach, referee, staff member, or guest

·               No alcohol, illegal drugs, or controlled substances on the premises

·               No unauthorized access to restricted areas of the facility

·               Proper athletic footwear required on court surfaces at all times

·               No food or beverages on the court — concessions area only

·               Parents and spectators must remain in designated spectator areas during games

·               SABA staff and officials have full authority to remove any individual for rules violations

·               SABA is not responsible for lost, stolen, or damaged personal property

·               All participants must check in at the front desk upon arrival

I understand that violation of facility rules may result in immediate removal from the facility without refund, and may result in a ban from future SABA events and activities.

GOVERNING LAW & SEVERABILITY

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. Venue for any dispute arising under this Agreement shall be in Bexar County, Texas. If any provision of this Agreement is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. This Agreement represents the entire agreement between the parties regarding its subject matter and supersedes all prior discussions or agreements.

ACKNOWLEDGMENT

All participants and guests acknowledge and understand that entrance and/or participation in basketball and related athletic activities at the San Antonio Basketball Association & Sports Armour Basketball (SABA) facility involves inherent risks, dangers, and hazards.  This waiver of liability, release of claims is posted at each entrance and exit at the facility.
